TABOR trial: Attorneys grapple over admission of witnesses, evidence

Attorneys are in Oklahoma County District Court today wrangling over the admission of witnesses and evidence in the criminal trial of three defendants accused of violating Oklahoma law relating to circulation of initiative petitions. The preliminary hearing centers on the Taxpayer Bill of Rights initiative petition, which was thrown out by the Oklahoma Supreme Court, chiefly over use of out-of-state circulators, which is prohibited by state law. Defendants include Rick Carpenter, chairman of Oklahomans in Action, the key state TABOR support group; Susan Johnson, president of National Voter Outreach, which conducted the signature drive; and Paul Jacob, president of Citizens in Charge. The three are each charged with one felony count of conspiracy to defraud the state. The potential penalty for conviction of conspiracy to defraud the state is 10 years in prison, a $25,000 fine, or both.
